In order for a South Carolina court to decide what money damages to give in a wrongful death lawsuit, it must look at the money that has been lost.  The court may consider other types of loss, such as emotional loss; however, that loss must be one that can be calculated in order for the family member to be paid.  Some financial expenses of your deceased loved one that the court will consider are the annual wages, the financial dependence of the family members on the decedent, the amount of the decedent’s savings, any other assets, medical costs and funeral costs.  When looking at the decedent’s finances, a South Carolina court will also consider things such as the decedent’s life expectancy (including overall heath), earning potential and the loss of household duties (including household care, child care and/or caring for other family member’s financial or living needs).  In some cases, if the decedent was in school to prepare for a career, the court may take that loss of future career and increase in earning potential into consideration as well when deciding how much money to give to family members.
